The Failure of the 28-Clause Peace Initiative for Ukraine: Why Peace Negotiations Continue to Stumble

Europe experienced widespread relief on Monday, as the diplomatic emergency caused by the announcement of a new 28-point plan for achieving ceasefire appeared – momentarily – to have been stabilised. A senior US official spoke of "notable headway" after bilateral negotiations in Geneva. On Monday night, Moscow made its retaliation: another massive barrage of missile and drone strikes on Kyiv.

The Cycle of Negotiation and Warfare

The sequence of opposing developments captured the bleak nature of the recent timeframe. By day, diplomatic battles are fought: optimistic declarations are released from different nations. Considerable effort is expended on managing certain initiatives. By night, the Kremlin forcefully demonstrates the world that, for them, conflict continues to be the main instrument for achieving "peace".

Nighttime Reality

As Russia's attack progressed into the early hours of Tuesday, the current condition of Ukraine's defenselessness was revealed. Ukraine is equipped to monitor projectile deployments from across the border, a capability enabled by up-to-date information. From vantage locations, military aircraft that had been deployed to intercept incoming cruise missiles flew past – sophisticated military planes delivered to Ukraine by European allies.

Soon thereafter, Kyiv's missile defense engaged: several firings targeted at a Russian ballistic missile. This was a advanced protection mechanism at work, presumably provided by partner states. Every launch creates sudden vibrations, shaking the windows. The brief panic quickly gives way to grim resignation: maybe the hostile projectile won't strike its target this time, protecting urban areas from catastrophe and additional electricity failures.

Persistent Threats

Following this, a heavy machine gun fired at a drone in the vicinity, part of a rapid response unit – probably Western-made equipment. Sadly, the projectiles didn't strike the opposing UAV – it maintained course toward its destination.

Periodically, this carried on until dawn. Kyiv faced the morning news: multiple fatalities, damage and utility failures in many homes as a result of the evening attack. As always, everyone still went about their day – living the war. But those entire period demonstrated Ukraine's critical military reliance on external assistance – a need that neighboring countries are demonstrably unable to fill in the near term.

Ineffective Peace Efforts

The detailed framework from American leadership sparked intense emotion, controversy and serious worry – and momentarily shifted focus from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after previous diplomatic encounters and multilateral gatherings.

Every new approach from US leadership adheres to the identical sequence: a negotiation push against Ukraine, which Kyiv, with allied governments, effectively counters. They manage the tension but never actually achieve victory. This pattern will, certainly, persist.

Tactical Assessments

It is tempting to accuse specific actors of repeatedly advocating Moscow's conditions. But that does not seem to be the entire situation. Washington works based on a assumption familiar among experienced diplomats: you cannot secure via talks what you have failed to defend militarily. The White House believes that it is unrealistic to force Russia to abandon the land that it already controls in Ukraine's southern or eastern regions.

The challenge is that while accepting these circumstances, American administration does nothing to discourage Russia, through statements or actions, from believing that the status quo will not change more in its benefit in the months ahead.

Opposing Positions

Therefore, Moscow is confident that duration works to their advantage – that Ukraine and its partners are approaching exhaustion. Their incentive to accept conditions that does not give them the maximum possible gain is close to zero. There may be numerous efforts to stop fighting, but they will continue as long as Russia's leadership remains highly assured in the result.

On the contrary, Ukraine's government believes that Ukraine can still endure, slowly losing civilians and areas but averting a entire defensive failure until conditions improve in its favour.

Existing Situation

Realistically, there are no actual prerequisites for a ceasefire. Now, personal considerations are becoming relevant: personal goals to negotiate peace and obtain worldwide acknowledgment, and the government's twin challenges – on one hand, not to alienate a key ally, and on the other, to unite the population around the country's interests against any plan Kyiv finds unworkable, so that their focus does not shift toward homefront challenges. And although their mission will now be considerably more difficult after latest incidents, it remains quite doubtful that this will alter their fundamental strategy.

These conflicting dynamics are driving the talks.

Conclusion and Outlook

It took a mere seven days to terminate the suggested clauses of the latest plan. Forceful and unpredictable management of the matter by US administration, pushback by Ukraine and the rest of Europe, along with calming attempts of diplomats, and finally, current information leaks, all achieved their purpose.

While new proposals based on previous concepts are forthcoming, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to fend off negotiation assaults from Washington that are based on Russian demands and demonstrate specific hesitation to alter the situation, if they remain united and improve their protective measures at a significantly accelerated rate. If they do, neither political nor armed coercion will be able to break them. In the meantime, Ukraine's ability to repel nightly air assaults will, for the coming months, largely rely on continued Western support.
